Circular 230: Free CLE ethics credit, videotaped lecture by Ronny Buni

Practice before the IRS includes a wide range of activities, including the rendering of written federal tax advice. Lawyers, their managers, and even law firm partners with no direct connection to the handling of federal tax matters should be familiar with Circular 230 if anyone at their firm gives federal tax advice.
The lecture was delivered on December 17, 2010 and provides an overview of Circular 230, with special focus on subpart B, which governs professional conduct in practice before the IRS. The latter part of the lecture gives special focus to the rules governing covered opinions under section 10.35 of subpart B.
Mr. Buni suggests that the nearly ubiquitous disclaimers on emails and other documents that an attorney’s advice cannot be relied on to avoid federal tax penalties are an overreaction to Circular 230 and show poor grasp of its concepts.
Attorneys are also made aware of proposed rules that would require both signing and certain non-signing preparers to apply for, obtain, and annually maintain a PTIN issued by Treasury. (As of January 6, 2011, these rules are not yet final).
The lecture is of interest to lawyers who practice before IRS, their managing attorneys, partners of law firms where other partners or employees practice before IRS, and also to counsel for OPR (Office of Professional Responsibility) for the purpose of monitoring and understanding the response to Circular 230 within the legal community.
